  • SIU/Fraud

In today's claims environment, ASW focuses on these two separate, but often related, areas of concentration. With a dedicated group of attorneys, we focus a significant percentage of our practice on matters involving both first and third party insurance coverage, including both primary and excess policies.

ASW has handled every phase of such matters, from consultations and opinions, to litigation and appeals. As the insurance industry has grown more sophisticated and specialized, our experience has widened to encompass coverage issues arising in a wide variety of insurance products, including: Professional Liability; Directors & Officers; Errors & Omissions; Commercial Property; Commercial Auto; CGL; Personal Umbrella; Environmental; Life Insurance; Homeowners; Personal Auto; Commercial Umbrella; Municipal/Public Officials Liability; Garage; Workers' Compensation; Employment Practices Liability; Reinsurance; Truckers Liability; Healthcare Management; Special Risk; Event Liability; Disability.

As in any other substantive practice area, but perhaps even more importantly, in this particular instance, our bad faith practice offers both an opportunity and a responsibility to examine larger claims handling policies, not just particular cases. In this evolving area of the law where both substantive and procedural issues are often being decided for the first time. We are eager for the challenge of representing your interests in this complex arena.

ASW’s SIU and Insurance Fraud lawyers have the knowledge and experience to fully investigate potential fraudulent claims. We also have extensive experience in handling claims in which an insurer is faced with the possibility and/or presented with allegations of bad faith. Florida law presents unique challenges to an insurer in these situations and our attorneys have been able to effectively work with insurers to minimize their exposure to such potential claims.

The attorneys in this practice group have also worked with employers and their insurers in defending Coverage (B) claims. Our attorneys have successfully defended hundreds of claims against employers, where claimants have sought to impose liability for workplace incidents and have obtained favorable results, including summary judgments, verdicts and advantageous settlements.
