Construction

Our attorneys have assisted clients in contract preparation and negotiation, contract administration, legal counseling, and the analysis and resolution of change orders, claims and disputes in litigation, arbitration and mediation proceedings. ASW has represented general contractors, design professionals, and owners in virtually all types of construction matters in both the private and public sectors. We have also represented subcontractors, sureties and suppliers.

Our experienced trial attorneys have also prepared, analyzed, defended and prosecuted many types of construction claims, including: claims for differing site conditions, acceleration, changes, defective plans and specifications, delay, disruption, inefficiency, suspension and termination.  We have also represented consultants in engineering, architecture, project scheduling, financing, and other such disciplines.

ASW handles trials and appeals in construction cases in state and federal courts. In addition, many construction disputes are resolved through arbitration, or by alternative dispute resolution, which provides a less formal setting, but requires sophisticated representation.  We have experience with multiple forms of alternative dispute resolution proceedings, including arbitration and mediation under the auspices of entities such as the American Arbitration Association. These cases involve construction claims ranging from relatively small amounts to multi-million dollar disputes.
