- Firm Obtains Defense Verdict in Medical Negligence/Colonoscopy Case

Plaintiff alleged that the Defendant doctor's care and treatment of the decedent fell below the requisite standard of care when she negligently suspended decedent's Coumadin therapy for a week prior to performing a colonoscopy with polypectomy.  Plaintiff also alleged that the Defendant doctor, a surgeon, was negligent when she performed the colonoscopy with polypectomy and caused the death of decedent in Leesburg.  According to Plaintiff, the Defendant doctor should have biopsied or removed the polyps she encountered during the colonoscopy, as the polyps were small and not cancerous.  In addition, Plaintiff alleged that the Defendant doctor failed to inform the decedent of all the inherent risks associated with suspension of Coumadin prior to performing the colonoscopy with polypectomy.

Plaintiff alleged that decedent sustained a stroke after his Coumadin therapy was negligently suspended.  Defendant's expert opined that discontinuing the Coumadin therapy was appropriate and met the requisite standard of care.  Defendant's expert concluded that all polyps should be removed due to the risk of developing cancer. 

Verdict rendered for the Defendant.
